ISLAMABAD - The Islamabad High Court (IHC) Monday summoned inspector general (IG) of Islamabad police to appear before the court in person on February 9 for defying court’s orders about registration of first information report (FIR) against former Central Intelligence Agency (CIA) station chief in Islamabad Jonathan Banks over deaths of civilians in US drone attacks.

A single member bench of IHC comprising Justice Shaukat Aziz Siddiqui issued these directions to the IGP in a contempt of court petition wherein a petitioner contended that Secretariat police had not registered the FIR despite court’s orders in this matter.

It was on June 05, 2014 when the same IHC bench had directed Secretariat police station to register FIR against the former CIA station chief in Islamabad Jonathan Banks and former CIA General Counsel John A Rizzo in the matter of a North Waziristan resident Kareem Khan whose brother and a son had died in a drone strike in 2009 in North Waziristan.

On Monday, Station House Officer (SHO) police station Secretariat appeared before the court and on this occasion, Justice Siddiqui expressed his resentment why the case was not registered even after jurisdiction was established and it was a cognizable offence.

Advocate Mirza Shehzad Akbar, the counsel for Kareem Khan, contended before the court that contempt proceedings may be initiated against the respondent police officials for defying court’s orders.

Talking to this scribe, Mirza Shehzad said that the SHO informed the court that commissioner Islamabad had written a letter to the FATA Secretariat seeking their advice over this issue. Then FATA Secretariat responded that there is a military operation going on at the moment and once this operation gets ceased, it will then look into the matter. However, Justice Siddiqui expressed his dissatisfaction and directed the IGP to appear in person on the next hearing.

Kareem Khan, a resident of North Waziristan Agency, had lost his teenage son Zahinullah and a brother Asif Iqbal who was a primary school teacher in Mirali, in a drone strike on 31st December 2009. Kareem Khan is a native of Machi Khel, Mir Ali, North Waziristan, and had filed an application for FIR with the Secretariat police station of Islamabad in 2010 but Secretariat police refused to lodge the FIR.

Then Kareem Khan filed a case under section 22-A with the civil court of Islamabad while praying that the police may be directed to register the FIR. But a civil judge of Islamabad dismissed the application in December 2013 citing lack of jurisdiction as the reason. Kareem Khan then filed an appeal with the IHC when the court on June 05, 2014 had directed police to register the case. He had pleaded in his petition that drone strikes killed innocent civilians, adding that his relatives were also among the victims of these attacks. Khan added that the drone attacks took place on the orders of the ex-CIA station chief, which implicated his direct involvement in the matter.
