The petitioner Ayyaz Khan, general secretary Peshawar High Court Bar Association (PHCBA) has taken plea in his petition that as per constitution chief minister cannot take part in “dharnas” and making announcement of civil disobedience in the presence of a chief minister is unconstitutional. Province is a part of federation and the decision taken in the “dharnas” is tantamount to harm federation. On the other hand provincial resources are being used in “dharnas”, he added. Therefore court should disqualify chief minister KPK and speaker KPK assembly Asad Qaisar for violating the constitution, he prayed.
