LAHORE - The Lahore High Court Division Bench headed by Chief Justice Ijaz Ahmad Chaudhry Friday admitted Ayesha Ahad Malik, the daughter of former MPA, Ahad Malikl, to bail in a case registered with the Defence Women Police Station on the complaint of a Philippines lady for allegedly kidnapping her son Joseph for ransom on September 27. SC, Anti-terrorism, Lahore had remanded the petitioner, Ayesha on Oct 4 to policy custody till Oct 14, and she questioned this order through the writ petition before the LHC. She also assailed the charges against her and says she is being politically victimised as she committed no offence. Ayesha was taken into custody on Oct 3 before the Court of Additional Judge, could decide on her plea for pre-arrest and was taken to Police Station Race Course where she learnt that that her custody has been affected on the charges of hurling threats of serious consequences to the complainant. A habeas corpus petition for her recovery and against the illegal custody was also moved besides challenging the 10-day remand given for the physical custody of the petitioner allegedly without applying the judicial mind on the evidence against the petitioner and contrary to the scheme of law. Pursuing direction of the Court, SHO Defence appeared and presented a report which the court disapproved as not satisfactory. The court expressed anger over the SHO for not meeting the four corners of law about the case and remarked that had it been a complaint from an ordinary citizen, the SHO would not have even taken it under consideration what to say of registration of an FIR on it. The court ordered that investigation of case would be carried out by DIG Major Mubashir Ullah. The CJ remarked the judicial officer does not merit the office for giving the petitioner to 10 days physical remand and admitted the petitioner to bail on her furnishing surety bond in the sum of Rs 10, 0000 while suspending the impugned order.
