LAHORE - Lahore High Court Chief Justice Khawaja Muhammad Sharif Friday took suo moto notice of a condemned prisoners miseries who was languishing helplessly in a death cell for the last 16 years because his appeal was never heard during that period. The CJ has sought reasons from Additional Advocate General Muhammad Hanif Khatana besides directing the LHC registrar to find out the record of appeals of speedy trial court that convicted the said condemned prisoner. The CJ pointed out the trial court that awarded death sentence to Aftab Masih in 1993, were called as speedy trial court and its appeals were used to be heard by three judges - one from the Supreme Court and two from the concerned high court of the province. The CJ also directed the superintendent Kot Lakhpat Jail to appear on May 11 along with the complete record of the said prisoner. The CJ said that he had met Aftab during his visit to the Kot Lakhpat Jail along with Chief Justice of Pakistan Iftikhar Muhammad Chaudhry on May 2. I was shocked to know as to why this condemned prisoner was in the death cell since 1993. The superintendent jail was called but he also failed to trace out the fate of his appeal. Then the IGP was directed to check the record from police station concerned where results of all decisions were recorded in a column of an FIR. But the IG told the CJ that only the result of trail court was mentioned in the FIR.
