ISLAMABAD While declaring the degree of JUI-F MPA Haji Gulistan Bhittani as fake, the Supreme Court on Tuesday directed the Election Commission of Pakistan to issue a fresh election notification for PF-69 Tank, NWFP, declaring PML-Q candidate Habibullah Khan Kundi as winner. A three-member bench, comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Ghulam Rabbani and Justice Khalil ur Rehman Ramday, issued the directive on a plea of Haji Gulistan Bittani against a decision of Peshawar High Court Election Tribunal concerning his educational qualification. The Bench after hearing arguments of counsel for Habibullah Khan Kundi, a PML-Q candidate, and Mustafa Kundi of PPP, observed that the apex court had already decided the cases of Deeni Madaris degrees and laid down a law. The Bench in its earlier order had stayed the matter and barred Habibullah Kundi from taking oath as MPA, till a decision on the case, and suspended a decision of Peshawar High Court Election Tribunal. It is relevant to mention here that the PHC Election Tribunal on April 15 had disqualified Gulistan Bittani as a member of provincial assembly, holding that his bachelors degree from a religious institution was not equivalent to a Bachelor of Arts (BA) degree, which was a requirement in February 18, 2008 general elections. The PHC Election Tribunal, headed by Justice Dost Mohammad Khan, had also ordered the Election Commission of Pakistan to issue a notification of Habibullah Khan Kundi, a PML-Q candidate, as successful on PF-69 Tank.
