LAHORE - The National Coordination Council headed by Aitzaz Ahsan on Thursday failed to announce any move to put pressure in a big way on the govt to force it to reinstate deposed Chief Justice Iftikhar Muhammad Ch and other judges. This came to light when the NCC meeting could not take any hard-hitting decision even though Aitzaz said the Steering Committee had approved the decision of Bar Associations of Southern Punjab to lock the court rooms of respective cities. He, however, hinted at staging countrywide protests even in Ramazan if required. Addressing a Press conference at LHCBA Karachi Shuhada Hall after having a long heated debate in council's in-camera meeting where he was severely criticised, Aitzaz expressed regret that Asif Ali Zardari had taken oath from an unconstitutional sitting Chief Justice Abdul Hameed Dogar. He made it clear that Zardari is a Constitutional President despite some doubts about his taking oath from Chief Justice Dogar. The lawyers were expecting that NCC would come up with a drastic move in the circumstances where the support for the deposed CJP is thinning fast after his sacked colleagues had accepted govt's offer to accept reappointment. Announcing the decisions taken in the NCC meeting, Aitzaz reiterated that after Eid-ul-Fitr, the lawyers would continue countrywide sit-ins in case the deposed CJP and other judges were not reinstated. He said that the lawyers would ensure complete and effective boycott of SC in Islamabad next Thursday. He said after Eid the lawyers convention would be held in all the four provinces to mobilise the people and the lawyers. The schedule of these conventions would be issued after Eid, he added. The NCC Steering Committee had also endorsed the decision of organising two day international conference on the subject of 'independent judiciary' in Islamabad on October 10 and 11. The NCC also approved the name of Ali Ahmed Kurd for the Presidential candidate for upcoming election of Supreme Court Bar Association. There was nothing threatening for the govt as far as the decisions taken in NCC meeting were concerned while Aitzaz faced bitter criticism from lawyers leaders for siding with PPP and President Asif Ali Zardari. Arshad Baggu, President Sialkot Bar Association, came hard on Aitzaz saying he should clarify his position whether he was with lawyers movement or loyal to his party. This irked Aitzaz and he exchanged harsh words with Baggu, however the interference of senior lawyers calmed the situation. You are sailing in two boats. Quit one, asserted Baggu. An angry Aitzaz retorted: 'I would leave one' to which Baggu hit back in the words 'you always say this but never do so'. President Gujrat Bar Association, also a cousin of Aitzaz and Secretary Rawalpinidi Bar Association Shafiq Awan also expressed the same views, saying he would have to make an unambiguous decision that which side he want to choose and support wholeheartedly. Aitzaz replied that he did not withdraw his stand on judges issue even after having meeting with Zardari. At this the criticising lawyers said,'but at the same time you failed to convince him too'. Having taken the criticism at heart, Aitzaz stood up and was about to leave the meeting when Tariq Mahmood, former President SCBA, stopped him and took control of the situation. Aitzaz went on to say that lawyers movement forced Musharraf to doff uniform and eventually quit the office of President. Without naming Zardari, he said he was not expecting from country's top leadership that it would back out from its promises made to nation on judges issue. He said that Asif Ali Zardari is a Constitutional President, however, lawyers do not recognise Abdul Hameed Dogar as the Constitutional Chief Justice. Reiterating his claim that Justice Iftikhar Chaudhry is the Constitutional CJ of Pakistan, Aitzaz hoped that Iftikhar will soon resume his work as CJP. Secretary SCBA Ch. Amin Javed, former President SCBA Justice (Retd) Tariq Mehmood, President LHCBA Anwar Kamal, Secretary Rana Asadullah Khan, Secretary LBA Latif and member Pakistan Bar Council Hafiz Abdul Rehman Ansari were also present on the occasion. Disclosing the decisions of the meeting, Aitzaz said that the Steering Committee with the consultation of all lawyers bodies has decided to field Ali Ahmad Kurd for the slot of President SCBA 2008-09. Aitzaz announced that legal fraternity would observe 'Justice Iftikhar Day' on September 23. Responding to a query about his meetings with Asif Ali Zardari on judges issue, Aitzaz said that he did not think necessary to take his lawyers friends in confidence. Because all the lawyers had complete confidence in him, he added. Answering another query, he said Inshallah Iftikhar Muhammad Chaudhry would sit in his court again and Asif Zardari despite taking oath from 'unconstitutional' Chief Justice was Constitutional President of the country. 'We had cautioned the judges who took fresh oath recently about their seniority claimed by the govt', Aitzaz replied to another question. The movement of lawyers was not for any individual but for the independence of whole institution of judiciary and judiciary could not be independent without sovereign judges, he added.
