A reference has been sent by one Saeed Malik, a lawyer in Supreme Judicial Council (SJC) against justice Azmat Saeed Sheikh, senior most judge of Lahore High Court (LHC). Saeed Malik has taken plea in the reference that Justice Azmat Saeed Sheikh has favored the accused persons in a case and due to which justice has not been administered to him. This has been done at the behest of an influential political person, therefore, proceedings be initiated against him under article 209 of the constitution and justice Azmat Sheikh be restrained from functioning as judge unless reference is decided by SJC , he pleaded. According to court sources SJC would now review legal status of the reference if it has been sent to SJC as per rules and regulations. If this reference is admitted for hearing then the council will summon parties and deliver its decision after hearing the stance of both the parties. Legal experts are of the view that as the reference has been sent on individual basis and justice Azmat Sheikh is charged with allegedly favoring accused and it will be essential that its evidence be provided. As justice Azmat Sheikh has not committed any misconduct therefore, the reference does not seem to be meeting the legal requirements.
