ISLAMABAD: Justice Ejaz Afzal Khan has remarked what a good Islamic state it is that influential have been let off and action has been initiated against the weak.

He further observed that “case should have been registered against chairman CDA. No go areas are still existing in urban areas of Islamabad. Effective action has not been taken despite court’s orders so far.

Justice Qazi Faiz Essa remarked “blocking the roads by erecting illegal barricades in residential areas is criminal act. CDA has committed contempt of court by not taking any action so far. Contempt of court proceedings should be initiated against chairman CDA and the responsible persons. Orders were issued repeatedly by the court. We are giving last chance now and no more chance will be given afterwards.” A 3-member bench of SC presided over by Justice Ejaz Afzal Khan took up the case for hearing today.

CDA member planning told the court during the course of hearing of the case that 66 buildings had been sealed and owners of 123 places have vacated them on their own. About 2000 non verified offices and buildings are existing and period of 15 days is needed in this respect.

It was also brought into knowledge of the court that cases were registered against 52 officers and 14 officers among them have been arrested. Due to this reason action could not be taken against non verified offices and place. We assure the court that we will take action if time is given, he said.

The court remarked “why are you taking action against the weak only. This is concept of Islamic state that indiscriminate action will be taken.

CDA told the court in its report that offices of Jamaat-e-Islami are located in sector G-6/2, All Pakistan Muslim League in sector G-6/3, PPP in sector F-8/2, PML-N in F-8/3, PML-Q in F-7/3 and these all offices have been set up in defiance of law. Under interior ministry NADRA office has been set up in F-6/3, IGP office in sector F-7/1, IG Motorway office in F-8/3, Anti Narcotics office in F-8/3 and FIA offices in F-10/4 against CDA ordinance 1960 and CDA building and zoning regulations. CDA told that notices have been issued to these offices and sought time of 15 days from the court for initiation of action.

The court expressed displeasure over non initiation of action by CDA against the illegal offices remarking CDA chairman should file explanation on next hearing for not implementing court’s orders.

The court adjourned the hearing of the case till second week of January.
