ISLAMABD  - The National Database and Registration Authority Tuesday said that it had dismissed from service the deputy chairman of the authority Syed Muzaffar Ali Shah under the Nadra Employees Services Regulation 2002 and no court had granted a stay order restraining the authority from taking any strict action against him. 

An official of the Nadra explained that a local court had restrained the Nadra from taking any adverse action against Nadra deputy chairman contrary to the rules of the Nadra authority and Nadra Employees Regulation 2002.  

Nadra Chairman Usman Yousaf Mubin had recommended his dismissal as mandated under the Nadra Employees Regulation 2002, the official said. 

“The defendant/respondent are restrained from committing any injury of any kind contrary to the rules of the Nadra authority and [the] Nadra Employees Regulation 2002,” the official quoted some lines of order of a local court. 

On January 19, Nadra had dismissed Syed Muzaffar Ali on the recommendations of three-member inquiry committee of senior director generals.  

The officer was given personal hearing in front of Nadra chairman, the competent authority on January 18 but he did not appear before the chair. 

Syed Muzaffar Ali Shah was charged with misuse of authority and insubordination for overstepping his administrative mandate in case related to an inquiry against junior Nadra employee Shaheen Bukhari.  

Muzaffar Ali Shah was facing charge of converting the major penalty, imposed on Shaheen Bukhari by an inquiry committee, of removal from service into a minor penalty with censure.  

After two days of converting the major into minor penalty of censure, the same was converted into exoneration, the official said.  

The Nadra claims that deputy chief had no powers to exonerate the lady officer in violation of recommendation, of dismissal from service, of inquiry committee of an authorised officer of DG rank who conducted the inquiry against Shaheen Bukhari.  

According to the Nadra Employees Regulation 2002, such powers rest with the Nadra chairman, who is the only competent authority to decide such matters, the official said.
