Sindh High Court (SHC) has referred former president Pervez Musharraf writ against placement of his name on ECL to chief justice SHC for constitution of bench to hear it.

SHC bench comprising Justice Sajjad Ali Shah and Justice Salahud Din Babar took up the petition for hearing on Monday.

A Q Halipota counsel for Pervez Musharraf argued that open court  had not ordered for putting the name of his client on ECL when SHC had heard the petition of former president on March, 29, 2013. The bench which had banned Musharraf from going abroad should hear this petition.

Attorney General (AG) Munir A Malik while objecting to the petition said the affidavit filed with the petition is not from Pervez Musharraf but it has been given by his brother in law. “Therefore, time may please be given to me so that I could  file my written objection”, he prayed.

The court while giving time to AG maintained that as Pervez Musharraf seeks review of March, 29, 2013 decision therefore, we send this petition to chief justice for constitution of bench”.
