QUETTA - Balochistan govt has decided to approach Supreme Court against the verdict of Balochistan High Court declaring the Code of Criminal Procedure (Balochistan Amendment) Act and Ordinance, 2010 illegal and ultra vires of the Constitution. The provincial govt took this decision during a special meeting of provincial Cabinet held under the Chairmanship of Chief Minister Nawab Aslam Raisani. The meeting strongly condemned the NATO air raids in Mohmand Agency and termed it an attack on Pak sovereignty. Advocate General Balochistan Amanullah Kanrani briefed the govt about the verdict of Balochistan High Court over the Code of Criminal Procedure (Balochistan Amendment) Act and Ordinance, 2010 that high court said has no legal effect. The Ordinance was passed by Balochistan Assembly meant to introduce executive magistracy in the province of Balochistan and to entrust it with judicial powers to conduct trials and impose punishments. Division bench comprising Chief Justice Balochistan Qazi Faez Isa and Justice Muhammad Hashim Khan Kakar declared the amendment null and void. Member of Balochistan Bar Council and Judicial Commission of Pakistan for Balochistan Muhammad Kamran Khan Mulakhail had filed the petition. The meeting extended the ban on the entry of NATO containers and oil tankers into Balochistan. 'There will be ban on the entry of oil tankers and containers carrying necessary supplies for indefinite period, the meeting decided.
