Islamabad - A local court will resume the hearing of a petition seeking second FIR (first information report) of Lal Masjid operation against former military ruler Pervez Musharraf here on Wednesday (today).

Additional District and Sessions Judge Sikandar Khan will take up the application moved by one of the members of the Shohada Foundation Trust of Pakistan (SFTP) Jan Muhammad Qureshi, whose son Shahzad Qureshi had also been killed on July 5, 2007 during the Lal Masjid operation.

District Sessions Judge Islamabad West, Nazir Ahmed, declared the application as maintainable for hearing on the last hearing and transferred it for hearing before Additional District and Sessions Judge Sikandar Khan.

The petition was filed by SFTP seeking court’s directions for registration of the second FIR of the incident against former President Pervez Musharraf, former Prime Minister Shaukat Aziz and his cabinet members who had given approval of the operation.

Earlier, Additional District and Sessions Judge Wajid Ali Khan had recused himself from hearing the application, saying that he was already hearing an application of similar issue (murder case of Abdul Rashid Ghazi and his mother).

Malik Abdul Haq Advocate, counsel for the petitioner, maintained in the application that the first FIR was registered on the complaint of Haroon Rashid and now the application for second FIR was filed by one of the members of the Trust Jan Muhammad Qureshi, whose son Shahzad Qureshi had also been killed on July 5, 2007. Musharraf’s counsel Advocate Akhtar Shah contended that an FIR had already been registered against his client in Lal Masjid operation case. He added that the SFTP also nominated his client as major accused in the application for the second FIR registration. He requested the court to issue directions for the exclusion of Musharraf’s name from the SFTP application seeking registration of the second FIR.

After hearing arguments from both sides, the court declared the petition as maintainable and transferred it for hearing before the court of Additional District and Sessions Judge Sikandar Khan who will take up the matter on Wednesday (today).

The applicant had nominated former President Musharraf, former PM Shaukat Aziz, President Pakistan Muslim League (Quaid) Chaudhary Shujaat Hussain, former chief minister Punjab Chaudhary Pervaiz Elahi, former Railways Minister Sheikh Rashid Ahmed, former Religious Minister Ejaz-ul-Haq, former Interior Minister Aftab Ahmed Khan Sherpao, former Information Minister Muhammad Ali Durrani, Faisal Saleh Hayat, Khurshid Qasuri, former State Minister Tariq Azim, former Secretary Interior Kamal Shah, former Chairman CDA Syed Kamran Lashari, former Director Crisis Management Cell Javed Iqbal Cheema, former Commissioner Islamabad Chaudhary Khalid Pervez and some other members of the federal cabinet of 2007 in his application submitted with the police station. He requested in the application for registration of case against the nominated people under sections of murder, attempt to murder, blasphemy of Quran and Hadith and terrorism.
